THE PEAK TRAVEL SERVICES, LLC TERMS AND CONDITIONS
PLEASE READ CAREFULLY BEFORE BOOKING A TRIP WITH THE PEAK TRAVEL SERVICES
The following Terms and Conditions (the “Agreement”) apply to all group trips offered by The Peak Travel Services (“The Peak,” “we,” “our,” or “us”). By booking a trip, you (“you,” “your,” or “traveler”) confirm that you are at least 18 years of age and agree to be bound by this Agreement.
1. Trip Price, Payment Terms & Late Fees
All trip prices are listed per person. Options for single and shared occupancy will be available. Single room upgrades may be available at an additional cost. Prices do not include airfare unless specifically noted.
A non-refundable, non-transferable deposit is required at booking to secure your spot. Payment plans may be offered, with installment details shared post-booking. All payments are subject to transaction fees.
Final Payment is due no later than 60 days before the trip start date. The Peak reserves the right to cancel your reservation without refund if your full payment is not received on or before the Final Payment date.
2. Minimum Enrollment Requirement
Each group trip is subject to a minimum number of confirmed travelers. Unless otherwise stated, the trip is confirmed once at least 8 travelers have submitted their deposits.
If the minimum is not met by 60 days before the trip start date, The Peak may: Cancel the trip and issue a refund (less transaction fees); or Offer to roll payments over to a rescheduled or future trip. Travelers will be notified by email about trip status.
3. Force Majeure
The Peak is not liable for failure to perform due to events beyond our control (e.g., acts of God, weather, strikes, civil unrest, government restrictions, pandemics).
In such cases:We will make reasonable efforts to reschedule or offer credit. If rescheduling is not possible, we may issue a refund, minus non-recoverable costs and transaction fees. We are not responsible for airfare or travel arrangements not made by The Peak.
4. Changes to the Trip
We reserve the right to make changes to any part of the trip—accommodations, itinerary, activities, etc.—for safety, weather, availability, or commercial reasons. No refunds or compensation will be issued for such changes.
5. Cancellations & Refund Policy
5.1 Cancellation by You
Refunds, less the non-refundable deposit and any transaction fees, are permitted if requested in writing more than 90 days before the trip start date. No refunds will be issued for any reason within 90 days of the trip. To request a refund, you must email info@thepeakoftravel.com with the subject line: “Refund Request.”
5.2 Cancellation Due to Non-Payment
Failure to pay by the final deadline may result in cancellation of your reservation and forfeiture of all payments.
5.3 Cancellation by The Peak
We reserve the right to cancel a trip for any reason, including but not limited to low enrollment or other commercial considerations. In such cases, you will receive a full refund of all payments made, excluding any transaction fees. However, The Peak is not responsible for reimbursing airfare, visa fees, travel insurance, or any other incidental costs incurred by the traveler.
6. Transfers & Substitutions
Reservations may be transferred to another individual only if the request is approved by The Peak and the applicable $150 administrative fee is paid. To request a transfer, email info@thepeakoftravel.com with the subject line “Transfer Request” and include the full name, email address, and phone number of the person you would like to transfer your reservation to.
7. Travel Insurance
Travel insurance is highly recommended for all travelers. We strongly encourage you to purchase a policy that includes coverage for trip interruption or cancellation, medical emergencies and evacuation, lost or delayed luggage, travel delays, and personal liability. Please note that The Peak is not responsible for any expenses, losses, or disruptions resulting from circumstances that would otherwise be covered by travel insurance.
8. Passports & Visas
You are solely responsible for obtaining a valid passport (valid for at least 6 months after your return date), entry visas, vaccinations, and compliance with destination entry/exit laws. No refunds will be issued for denied entry.
9. Airfare & Missed Connections
Airfare is not included unless specified. We are not responsible for flight delays, cancellations, or missed connections. We recommend booking flexible tickets and using insurance to cover disruptions.
10. Accommodations
Accommodations vary and may include shared rooms. Preferences are not guaranteed. Upgrades may be available at an additional cost. Check-in/check-out times may vary and are outside our control.
11. Medical Fitness & Participation Eligibility
By booking a trip with The Peak, you acknowledge that it is your responsibility to evaluate your own physical and mental readiness to participate in the trip and its related activities. You agree that you are in reasonably good health and understand that many of our trips may involve moderate activity such as walking, standing, stairs, or exposure to heat or varied weather conditions.
We encourage all travelers to consult with their physician before the trip, especially if you have any existing medical conditions, disabilities, or concerns that may impact your ability to safely take part in travel-related experiences.
While The Peak will do its best to offer support, you are ultimately responsible for knowing your limits and making decisions that prioritize your own well-being. If you experience any health issues or discomfort before or during the trip, we ask that you make safe choices for yourself and opt out of activities that may not be suitable for your condition.
We reserve the right, at our discretion, to limit or deny participation in specific activities or portions of the trip if we believe doing so is in the best interest of your safety or that of the group. Please note that refunds will not be issued for missed activities due to fitness or medical limitations, and any additional costs incurred will be your responsibility.
12. Code of Conduct & Removal from Trip
The Peak is committed to creating a respectful, safe, and positive experience for all travelers and staff. We maintain a strict code of conduct and reserve the right to remove any traveler from a trip if their behavior compromises the comfort, safety, or enjoyment of others.
Grounds for removal include, but are not limited to:
Behavior deemed disruptive, disrespectful, threatening, or inappropriate;
Harassment, discrimination, or abusive language toward staff, fellow travelers, or service providers;
Refusal to follow instructions, guidelines, or policies set by The Peak or its partners;
Any conduct that endangers yourself or others or creates an unsafe or hostile environment.
Travelers removed for misconduct will not receive a refund and will be responsible for any additional costs incurred as a result of their removal, including transportation, lodging, or alternative arrangements. The decision to remove a traveler rests solely with The Peak and will be enforced without exception in the interest of the group’s well-being and our brand standards.
By booking a trip, you agree to conduct yourself with integrity, kindness, and respect toward all members of the travel experience.
13. Damage to Property
By participating in a trip with The Peak, you agree to treat all accommodations, transportation, venues, and shared spaces with care and respect. This includes but is not limited to hotels, villas, Airbnbs, restaurants, and activity sites.
You are fully and solely responsible for any damage, loss, or excessive cleaning required as a result of your actions or negligence during the trip. If damage occurs to any property or venue and is determined to be caused by you, you agree to cover all associated repair or replacement costs, including any charges billed directly to The Peak by our partners or vendors. The Peak is not responsible for resolving or covering property damage on your behalf.
14. Assumption of Risk & Release of Liability
By booking a trip with The Peak, you understand that travel involves inherent risks that may include, but are not limited to, illness, injury, accidents, physical exertion, exposure to infectious diseases, theft, natural disasters, unpredictable weather, civil unrest, and transportation delays. You acknowledge that you are voluntarily participating in all trip activities and assume full responsibility for any risks or outcomes, whether known or unknown, that may arise during your participation. You are solely responsible for your personal health, safety, and belongings throughout the trip, including any medical or evacuation expenses incurred.
In consideration of being allowed to participate, you agree to release and hold harmless The Peak Travel Services, its employees, contractors, representatives, and affiliates from any and all claims, demands, or damages—including those arising from negligence—related to your participation in the trip. This release applies to all liabilities for personal injury, illness, property damage, emotional distress, or death that may occur before, during, or after the trip.
15. Third-Party Providers
The Peak partners with independent third-party providers—such as hotels, transportation companies, tour guides, and activity operators—to deliver parts of your travel experience. These providers are not employees or agents of The Peak, and we do not control their operations or policies.
By booking a trip, you acknowledge that The Peak is not responsible for any acts, omissions, errors, delays, cancellations, or failures by third-party providers. All services are provided “as-is” and are subject to the provider’s own terms and conditions, which you agree to follow.
16. Limitation of Liability
To the fullest extent permitted by law, The Peak disclaims liability for any indirect, incidental, or consequential damages, including emotional distress or lost property/profits.
17. Dispute Resolution
If a dispute arises out of or relates to your trip or these Terms, you agree to first engage in good-faith mediation in Jefferson County, Alabama, with both parties sharing the cost of mediation equally. If the dispute is not resolved within 30 days of written notice, either party may pursue legal action.
18. Complaints & Post-Trip Claims
If an issue arises during your trip, you must notify The Peak as soon as reasonably possible so we can attempt to resolve it in real time. We are committed to delivering a high-quality experience and can often address concerns more effectively when they are raised promptly.
To preserve any potential claim or request for compensation, you must submit your complaint or claim in writing within 7 calendar days after the trip concludes by emailing info@thepeakoftravel.com. Your written notice should include a clear description of the issue, relevant details (such as dates, names, or photos), and any documentation that supports your claim.
Claims received after this 7-day period may be considered untimely and could be denied at The Peak’s sole discretion. We are not responsible for addressing complaints that are not formally submitted in accordance with this policy.
19. Governing Law
This Agreement shall be governed and interpreted by the laws of Alabama. Legal action must be brought in Jefferson County, Alabama.
20. Amendments
The Peak reserves the right to update, revise, or amend these Terms and Conditions at any time, without prior notice, in order to reflect changes in our policies, legal requirements, or business operations. Any such changes will be effective immediately upon posting the updated Terms on our website or booking platform.
It is your responsibility to review the most current version of the Terms and Conditions prior to booking a trip. By continuing with your booking or participation in a trip, you agree to be bound by the Terms and Conditions in effect at that time. If you do not agree with any changes, your sole remedy is to discontinue your participation.
21. Photography & Media Release
By booking and attending a trip with The Peak, you acknowledge and agree that photos and videos may be taken of you throughout the trip by The Peak, its team, or a hired photographer. These images may be used for marketing purposes on our website, social media platforms, printed materials, or future promotional campaigns.
By participating in the trip, you grant The Peak permission to use any images or recordings of you for promotional use, without compensation or prior approval. On some trips, The Peak may provide access to a gallery of images captured by the photographer, either complimentary or for an additional fee.
If you do not wish to appear in marketing materials, you must notify The Peak in writing prior to the trip by emailing info@thepeakoftravel.com. While we will make reasonable efforts to honor your request, please note that we cannot guarantee exclusion from group or candid photos taken in public or shared.
